These Terms of Use (“Terms”) govern your access to and use of wxobservation.com (the “Site”), operated by Whyspire LLC (“WXObservation,” “we,” “us,” or “our”). By using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
Informational Purpose Only
The Site provides general educational information about weather, observing, forecasting concepts, weather stations, related technology, and products. Content is not professional meteorological, emergency, engineering, electrical, installation, legal, financial, or other professional advice.
WXObservation is not an official warning, forecast, or emergency service. Weather conditions can change quickly, and Site content may be delayed, incomplete, or inaccurate for your location. Do not rely on the Site as your only source for safety decisions. Monitor the National Weather Service, local authorities, emergency alerts, and other official sources. In an emergency, contact the appropriate emergency service.
Product Information and Safe Use
Product descriptions, specifications, compatibility, prices, availability, images, warranty information, and retailer terms can change without notice. We try to provide useful and accurate information, but we do not guarantee that every detail is current, complete, or error-free. Verify important details with the manufacturer or retailer before buying or using a product.
Follow manufacturer instructions, safety warnings, building and electrical codes, and applicable laws. Use qualified professional help when installation, mounting, wiring, lightning protection, work at height, or another activity calls for it. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY WEATHER INFORMATION, PRODUCT, LINK, OR THIRD-PARTY SERVICE WILL MEET YOUR NEEDS.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WHYSPIRE LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, USE, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM OR RELATED TO THE SITE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SITE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US, IF ANY, TO USE THE SITE DURING THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS.

Indemnification

Copyright Concerns
If you believe Site content infringes your copyright, contact us with your name and contact information, identification of the copyrighted work, the location of the material at issue, a statement explaining your good-faith belief, and any other information needed to evaluate the report. Knowingly false notices may create liability.
Changes, Suspension, and Termination
We may change, suspend, or discontinue any part of the Site. We may restrict access when reasonably necessary to protect the Site, users, or our rights. We may update these Terms by posting the revised version and changing the effective date. Your continued use after an update means you accept the revised Terms.
Governing Law and Venue
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law rules. Any dispute that is not subject to a mandatory legal right to another forum will be brought in a state or federal court with jurisdiction in Illinois, and you consent to that court’s jurisdiction and venue.
Severability, No Waiver, and Entire Agreement
If a provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These Terms, the Privacy Policy, and the Affiliate Disclosure are the entire agreement between you and Whyspire LLC concerning use of the Site.
